LAST WILL AND TESTAMENT OF CATHERINE ELIZABETH FAULKNER
(Also known as Catherine Elizabeth Harrison)
This is the last will and testament of me Catherine Elizabeth Faulkner of
Nagambie in the colony of Victoria, baker and confectioner. After payment of
all my just debts funeral and testamentary expenses. I give and bequeath all
my real and personal property whatsoever and wheresoever unto John Gordon of
Nagambie storekeeper and Edwin Walker Hall of sameplace auctioneer (hereafter
termed my said trustees) upon trust that they will as soon as they reasonably
can after my decease sell all in collect and convert into money so much of my
said real and personal property as may not consist of ready money and out of
the proceeds to arise therefrom and such ready money of which I may be possessed
at my death. Pay the sum of four hundred pounds to my daughter Ada Ouda, the
sum of one hundred pounds to my son Harry and stand seized of the remainder
as follows. The sum of one hundred and fifty pounds for my grand daughter May
to be paid after her attaining the age of twenty-one years or marrying before
that age, the sum of two hundred pounds for the five children of my son-in-law
William Edgar Lewis to be used by my said trustees in maintaining and the education
of the said children (if necessary) and if not so used to be paid to them in
equal proportions as each attains the age of twenty-one years or of a daughter
upon her marriage before that age. If there be any residue over and above the
before mentioned legacies I direct that a sum not exceeding forty pounds be
expended in the purchase and erecting of a railing and headstone upon my grave
and any further residue shall be held upon the trust here in before specified
for the five children of the said William Edgar Lewis. I further direct that
if my son Harry be not found within twelve months of my death his share is to
be held in trust for the same five children of the said William Edgar Lewis.
I also direct my said trustees to give the said William Edgar Lewis the option
of purchasing for the sum of six hundred pounds my real property consisting
of the land upon which I now reside and carry on my business together with all
buildings thereon and all fittings, bakery plant, horses and carts and everything
used in connection with the bakery business and also all my furniture. I also
direct that the said William Edgar Lewis shall have the option of purchasing
all of the stock of my shop at a valuation to be ascertained upon such basis
my said trustees may deem fair. I further direct my trustees to lend and advance
to the said William Edgar Lewis if he require the same to assist him in purchasing
the said property and stock the sum of three hundred and fifty pounds at a low
rate of interest and to give him such easy terms for the payment of the purchase
money as they in their judgment may do with safety to the interests of the other
legacees. I direct the said trustees to employ Henry Alfred Miller Bromfield
solicitor so long as he carries on business in Nagambie to do all the legal
work in connection with the proving this my will and fulfilling the trusts hereunder
and to pay him out of the said estate all reasonable costs and charges. I appoint
the said John Gordon and Edwin Walker Hill trustees and executors of this will.
I hereby revoke all former wills at anytime herebefore made by me. In witness
where of I have hereunto set my hand this first day of January one thousand
eight hundred and ninety-eight - C. E. Faulkner - signed and acknowledged by
the said Catherine Elizabeth Faulkner (the Testatrix) as and for her last will
and testament in the presence of us both present at the same time who at her
request in her presence and in the sight and presence of each other have hereunto
subscribed our names as witnesses - Annie Bray - Fred E. C. Parker - Baker Nagambie
